TERMS AND CONDITIONS
These Terms and Conditions apply to the use of a locker(s) (the “Locker”) in the FAU Marleen and Harold Forkas Alumni Center Room 103. You (also referred to herein as AA Member) agree that the following terms and conditions apply to your use of the Locker and You agree to comply with these terms and conditions:
1) ELIGIBILITY: In order to be eligible to use a Locker, the AA Member must be a Lifetime Member or current Annual Member of the FAU Alumni Association. Any AA Member who has or previously had delinquent payment accounts may not be offered a Locker.
2) TERM: The Locker term of use is July 1 - June 30 (“Term”). Upon any early termination of the use of the Locker as specified in these Terms and Conditions, AA Member must, within 48 hours of the notice of termination, remove their belongings from their Locker and vacate their assigned Locker. Otherwise, AA Member must remove their belongings from the Locker and vacate their assigned Locker no later than the date the Term expires. If AA Member fails to remove their belongings within the time period specified in this section, FAU may remove and dispose of items in the Locker.
3) PAYMENT OF CHARGES: Locker usage fees can be found at www.faualumni.org/lockers. AA Member agrees to pay charges before use of the locker. Fees are payable for the entire Term and are not pro-rated regardless of when the actual locker rental period commences. It is the AA Member’s responsibility to monitor their account and pay any outstanding balances before the applicable deadline(s).
A. Failure to pay fees when due and/or any outstanding University balance that is past due and failure to comply with these Terms and Conditions otherwise shall be considered a breach of these Terms and Conditions and may result, without limitation of FAU’s rights and remedies at law, in one or more of the following actions being taken: 1) immediate termination of the right to use the Locker; 2) denial of future use of Lockers; 3) referral to a collection agency; and/or 4) other action authorized by FAU rules.
4) USE OF ASSIGNED LOCKER: Use of the Locker is permitted only by the AA Member to whom the Locker is assigned and may only be used for the storage of personal items. AA Member may not sublet the Locker to any other person(s) or allow anyone else to use the Locker. It is prohibited to store or place the following items in lockers: flammable materials, hazardous materials, weapons, or controlled substances such as drugs and alcohol or any other items that create a health or safety risk or that create a nuisance. AA Member shall comply with all University rules as well as laws, rules and regulations relating to use of the Lockers. Use of the Locker in violation of this Section may result in automatic termination of your right to use the Locker. AA member will have access to locker during normal business hours and/or when the facility is open during alumni events only when Alumni/FAU staff are on premises.
5) CARE OF FACILITIES: AA Member is responsible for keeping the assigned Locker in a clean and sanitary condition.
A. AA Member agrees to refrain from modifying the Locker in any way. No stickers, decals, or markings of any kind are permitted on, or in, the Locker.
B. AA Member is responsible for damages, special cleaning, or maintenance resulting from misuse or modification of the Locker.
C. AA Member is expected to report damages and necessary repairs to the Department.
6) AUTHORIZED ENTRY: Lockers are the property of FAU and as such FAU reserves the right to have authorized FAU staff remove any Locker locks or re-key a Locker and/or open any Locker. AA Member does not have any expectation of privacy in the Locker or its contents. AA Member’s acceptance of these Terms and Conditions constitutes explicit consent for authorized personnel to access the AA Member’s Locker without further notice.
7) LIMITATION OF LIABILITY:
A. AA Member assumes all risk of loss related any personal property placed in the Locker. FAU recommends that AA Member not store any valuable items in the Locker. FAU shall not be liable for damage to or loss of AA Member’s personal property regardless of the cause or any fault of FAU or any other party and AA Member waives any such claims against FAU. FAU does not carry insurance on the Locker or its contents.
B. AA Member agrees to indemnify, defend and hold harmless FAU and its respective officers, trustees, directors, members, managers, agents, employees and legal representatives from any and all liabilities, claims, suits, demands, losses, damages, fines, penalties, charges, costs or expenses (including, but not limited to, reasonable attorney’s fees, costs and expenses) arising out of or related to AA Member’s use of the Locker, including any death, injury, damage or loss sustained by any person, including AA Member, AA Member’s guests and invitees.
BY ACCEPTING THESE TERMS AND CONDITIONS YOU AGREE THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS LISTED ABOVE AND THAT YOUR SIGNATURE ON THE APPLICATION FORM AND/OR ELECTRONIC ONLINE SUBMISSION INDICATES THAT YOU AGREE TO ABIDE BY, AND ARE LEGALLY BOUND, TO THESE TERMS AND CONDITIONS.
